How long we keep your information
We only keep your information for as long as necessary to fulfil the purposes for which it was collected and to meet our legal, regulatory and professional obligations. Different records have different retention periods. Clinical records are retained in accordance with applicable healthcare record retention requirements. Financial records are retained in accordance with taxation and accounting legislation. When records are no longer required, they are securely destroyed.
Clinic administration and medical records
The Nest operates as an independent private midwifery practice from consulting rooms at The Women's Health Hub in Jersey. To enable us to provide safe and efficient care, certain personal information may be shared with authorised administrative staff at The Women's Health Hub. This may include your name, contact details, appointment information and other information necessary to arrange appointments, communicate with you and manage the administration of your care. The Women's Health Hub provides administrative and secretarial support on behalf of The Nest. Administrative staff are bound by strict confidentiality obligations and only have access to the information necessary to carry out their role.
Your clinical records are maintained securely using EMIS, an electronic clinical record system widely used within healthcare. EMIS is designed to securely store confidential medical information and is used to document your consultations, assessments, treatment and ongoing care. Access to your clinical records is restricted to authorised healthcare professionals and authorised personnel who require access as part of providing or supporting your care. All Jersey GP surgeries and other approved healthcare services providers, such as the out-of-hours doctors, use a central medical records system known as EMIS. This allows access to a ‘shared record’ to ensure that the provider has immediate up-to-date and accurate information about your health and any current treatment you may be having. You have the right to ‘opt out’ of sharing some or all of your medical records. Please ask your GP surgery for more information and where appropriate an Opt-in/Out Form for completion. All approved healthcare service providers with authorised access to EMIS have signed strict confidentiality agreements which are bound by the Data Protection (Jersey) Law 2018.
Where appropriate, and only when necessary for your care or required by law, information contained within your clinical record may be shared with other healthcare professionals involved in your treatment, such as your GP, hospital maternity services or other specialists.
Marketing
If you have used our services, we may occasionally contact you about similar services that we believe may be of interest. You may opt out of receiving marketing communications at any time. We will never sell your information or allow other organisations to market directly to you.
Your rights
Under the Data Protection (Jersey) Law 2018, you have the right to:
• request access to your personal information;
• request correction of inaccurate information;
• request restriction of processing in certain circumstances;
• object to certain types of processing;
• withdraw consent where processing is based on consent; and
• make a complaint if you believe your information has been handled improperly.
Some of these rights may be limited where we have legal or professional obligations to retain healthcare records.
Making a complaint
If you have concerns about how your information has been handled, please contact us in the first instance. If you remain dissatisfied, you have the right to complain to the Jersey Office of the Information Commissioner.
